2、人人平等的刑法原则要求，所以说，将男性性权利纳入刑法的保护范围是非常必要的。男性相关权利的缺失主要体现在刑法对强奸罪、强制猥亵侮辱妇女罪等罪名中。当男性成为这两罪的被害人时，刑法对他们的救济接近空白，或者运用其他边缘法条制裁行为人，使得同样的犯罪行为由于侵害对象的性别不同而得到不同的刑罚，甚至造成有罪无罪的巨大差异。笔者在分析刑法保护人身权利缺失原因和完善刑法必要性的基础上，拟通过本文对完善我国刑法对男性人身权利的保护的对策作初步的探讨。关键词：性犯罪男性性权利刑法保护TheoryofmalesexualrightsprotectionofcriminallawAbstract：A

5、ctionofcriminallawisverynecessary.DeficienciesrelatedtotherightsofmenaremainlyembodiedinthePenalCodeforrape,forcedmolestationchargesaninsulttowomeninthecrime.Whenmenbecomevictimsofthesecrimes,thecriminallawfortheirreliefnearempty,ortheuseofothermarginalizedpeoplesanctionslaw,thesamecriminalact
