2、ople'sCourtonNovember22,2010the1502ndmeetingofthejudicialcommittee,isherebypromulgatedandshallcomeintoforceasofJanuary4,2011.TwoDecember13th2010Topunishtheillegaldepositsfromthepublic,financialfraudandothercriminalactivitiesofillegalfund-raising,accordingtother
3、elevantprovisionsofthecriminallawinthetrialoftheapplicationoflawissuesofsuchcriminalcasesisexplainedasfollows:Thefirstfinancialmanagementinviolationofstatelaw,tothepublic(includingunitsandindividuals)toabsorbfundsbehavior,atthesametime,withthefollowingfourcondi
4、tions,exceptotherwiseprovidedbylaw,article176thofthecriminallawshouldberecognizedas"illegalabsorbingpublicdepositsordisguiseddepositsfromthepublic":(a)withouttheapprovalofrelevantdepartmentsaccordingtolaworborrowfundsabsorbedformoflegitimatebusiness;(two)throug
5、hthemedia,presentations,flyers,mobilephonetextmessagesandothermeansofpublicitytothecommunity;(three)commitmentwithinacertainperiodofmonetary,physical,equityordebtservicepaymentsandotherwaysinreturn;(four)tothepublicthatthecommunityisnotaspecificobjecttoabsorbfu
6、nds.Notpublicizedtothecommunity,relativesorinternalabsorptionoffundsforaspecificobject,notillegalabsorptionordisguiseddepositsfromthepublic.Oneofthesecondimplementationofthefollowingacts,inaccordancewiththeprovisionsofthefirstparagraphofArticle1ofthisinterpreta
7、tionoftheconditions,shouldbeinaccordancewiththeprovisionsofarticle176thofthecriminallaw,thecrimeofillegaldepositsfromthepublicconvictionandpunishment:(a)therealcontentdoesnothavepropertysalesornotinrealestatesalesasthemainpurpose,toreturntothesales,customerserv
8、ice,sales,realestaterentalagreedtorepurchasesharesandothermeansillegallyabsorbingfunds;(two)thetransferofforestrightsandillegalfundsfortheprotectionofabsorptionmode;(three)t
