1、论中国移植辩诉交易制度的可行性内容摘要在现代刑事诉讼中，公正与效率是人们追求的两个基本价值目标。但是二者存在一定的矛盾和冲突，如何协调公正和效率之间的关系可以说是世界性的难题，美国的辩诉交易制度便是在此背景下应运而生的。任何一项法律制度都有孕育其生长发育的社会、文化环境，正是不同的社会、文化环境塑造了一项制度独特的内在运作机理，并通过外部环境的预设积极支撑着该制度的运行。美国的平等权利价值观、实用主义哲学观、契约文化、当事人主义对抗式诉讼等价值取向和诉讼理念，构成了美国辩诉交易制度的内在机理。中国目前同样存在司法资源的严重不足与案件数量日益攀升的尖锐矛盾，而
2、中国加入WTO后，诉讼效率问题则日益突出。为了有效解决这一问题，笔者认为可以合理借鉴西方的先进司法制度，为此，笔者对美国有效提高诉讼效率的辩诉交易制度得以产生的环境，内在机制等进行深入的、全面的研讨，从而得到深刻启示，认为美国的辩诉交易制度对中国的刑事诉讼程序的改革有着积极的借鉴意义。中国可以借鉴吸收辩诉交易制度的合理内核，结合中国的司法实践和法制进展状况，建立具有中国特色的辩诉交易制度。关键词：辩诉交易公正效率必要性可行性introducedanumberofleadingcreativetalents,andthenthe"introductionofa
