1、我国房屋拆迁中行政伦理问题研究摘要我国城市房屋拆迁始于上世纪90年代，房屋拆迁一方面使国有土地的使用权实行再分配，从而达到土地资源的合理配置，保证了城市建设的顺利进行，另一方面，使居民的居住条件、居住环境得到了实质的改善。但在拆迁过程中，也暴露了一些矛盾，如拆迁补偿款是否合理、是否不尊重居民意愿强制拆迁、是否合理安置拆迁居民等,最激烈的矛盾莫过于房屋拆迁补偿款。二十多年来，我国颁布了和修改了很多关于拆迁补偿的法律、法规、规章等，但未从源头上解决房屋拆迁款纠纷，未能真正保护被拆迁人的利益。本文根据现行房屋拆迁最重要
2、的法律依据《国有土地上房屋征收与补偿条例》，以及相关的法律法规，对目前我国存在的城市房屋拆迁法律问题进行分析探讨、思考。对城市房屋拆迁存在的问题进行法律思考，对城市的建设、城市化发展的进程、经济发展、社会稳定都具有极其重要的作用。笔者将本文分为四个部分：第一部分，阐释城市房屋拆迁的概念、特征、我国城市房屋拆迁法的立法沿革；第二部分，分析研判我国房屋拆迁存在的问题；第三部分，介绍美国、日本城市房屋拆迁情况及对我国的借鉴；第四部分，提出改善城市房屋拆迁存在的问题、提出相关的解决对策。通过本文，希望可以引起一些法律工作
