1、URDG758TheURDG758aretheUniformRulesforDemandGuarantees-effective01July2010.ForewordThisrevisionofICC'sUniformRulesforDemandGuarantees(URDG)isthefirstsincetherulesweredevelopedbyICCin1991.Theoriginalrules,URDG458,gainedbroadinternationalacceptanceinrecentyearsfollowingth

2、eirincorporationbytheWorldBankinitsguaranteeformsandtheirendorsementbyUNCITRALandleadingindustryassociations,suchasFIDIC.Thisfirstrevisionoftheruleswasmeticulouslypreparedoveraperiodoftwoandahalfyears,andistheresultofacollectiveeffortbyanumberofICCconstituentgroups.Itwa

3、sdevelopedasajointprojectbytwoICCcommissions-theBankingCommissionandtheCommissiononCommercialLawandPractice-thereforetakingintoaccountthelegitimateexpectationsofallrelevantsectors.ICCnationalcommitteescontributedsubstantiallytothefinalproduct:some52nationalcommitteessub

4、mittedseveralhundredpagesofvaluablesuggestionsonsuccessivedrafts,anumberofwhichwereincorporatedintothefinaltext.TheICCTaskForceonGuarantees,whichconsistedof40membersfrom26countries,reviewedthevariousdraftsandaddedtheirownsuggestions.TheURDGDraftingGroup,ablychairedbyDrG

5、eorgesAffaki,metonanumberofoccasions,carefullyreviewedallcommentssubmittedbynationalcommitteesandtheTaskForceanddevelopedthefinaldraft.Thiscollectiveefforthasbornefruit;ithasproducedrulesthatreflectabroadconsensusamongbankers,usersandallmembersoftheguaranteecommunity.In

6、fact,thepresentrevisionoftheURDGdoesnotmerelyupdatetheexistingrules.Itistheresultofanambitiousprojecttocreateanewsetofrulesforthetwenty-firstcenturythatisclearer,morepreciseandmorecomprehensive.Assuch,URDG758isdestinedtobecomethestandardtextfordemandguaranteesworldwide.
