1、保障权法律救济机制中最有效、最常用，并具有最终效力的司法救济机制在我国实施的不力，应着力从建立宪法诉讼机制、完善民事诉讼机制和健全行政诉讼机制三个方面拓垦我国社会保障权司法救济机制的具体路径。通过构筑社会保障权的立体救济网络，以促进我国社会保障制度日益走向成熟，推动社会保障法制不断趋于完善，最终使全体社会成员共享社会文明进步之成果――社会保障权。关键词：社会保障权社会保险权法律救济V机制AbstractInrecentyears,socialsecurity,asahotandcomplexissueinpresents

3、ishaharmonioussociety,thus,thestabledevelopmentofeconomy,theprogressesofsociety,andthewelfareofthepeopleallshouldbecountedonaperfectsocialsecuritysystem.Asabasicrightofmodernsociety,socialsecurityrightsserveasacoreissueofsocialsecuritysystem,alongtheway,asalogical
4、beginningtofigureoutsocialsecurityproblems.Socialsecurityrightscanbedefinedasthebasicrightswhichaimtomeettheneedofmaintainingsocialmembers’basiclifeconsumptionandevenprovingtheirlifestandards.Whenthesocialmembersareintroublewithsurvivalanddevelopment,theycangetama
5、terialhelpfromourcountryandsociety.Inshort,socialsecurityrightsarenotonlythebasichumanrights,butalsothebasicrightsenjoyedbyeverycitizen,andwhat’smore,concretelegalrights.Withoutrights,noonecanenjoyrelief;conversely,anyreliefisassociatedwithrights.And,thepromulgati
6、onandendowmentofrightsandtheirpracticalenjoymentshoulduserightsreliefsystemasitsbacking.Duetosomespecifictraits,socialsecurityrightsareexposedtoinvasionsandencroachmentsespeciallylaunchedbystateorganizations,artificialpersonsorsomeotherorganizations,thusmayarousea
7、conflictanddisputebetweenthebodyofsocialsecurityrightsanddutyrelatedpersons,then,therelativestateinstitutionsandorganizationshavetocompensate.Lawsshouldendowtherightsofcitizen’sreliefandgiveadefiniteregulationtothewaywelaunchrelief.Thisisessentialbecauseitisaneffe
