1、建立我国缺陷产品惩罚性损害赔偿制度研究摘要我国产品责任立法中是否应移植西方国家的惩罚性损害赔偿制度,已成为近年来法学界关注的一个热点。本文即围绕如何在我国确立科学合理的缺陷产品惩罚性损害赔偿制度以解决国内产品市场出现的假冒伪劣产品泛滥、产品侵权严重的现状展开论述。除前言和结论外,本文包括四大部分。第一部分从国内典型的有关缺陷产品的案例入手,指出我国产品损害赔偿体系的不足与建立缺陷产品惩罚性损害赔偿制度的必要性。第二部分,阐释了缺陷产品惩罚性损害赔偿的一般理论,并从惩罚性赔偿制度的功能、法律价值和现实需要三个层面对我国引入缺陷产品惩罚性损害赔偿制度的合理性进行了论述。第三部分,以美国为重
2、点,对该制度在普通法系和大陆法系国家的适用状况做了介绍,并对两个法系产品责任法中惩罚性损害赔偿制度的特点做了对比与总结,从而为我国惩罚性赔偿制度的合理构建奠定了借鉴的基础。昀后一部分是对我国缺陷产品惩罚性损害赔偿制度的立法构想,这一部分是本文的重点。在对我国产品责任损害赔偿的立法现状进行分析的基础上,笔者构建了我国缺陷产品惩罚性赔偿制度的立法模式,界定了适用该制度的主客观要件。在如何确定惩罚性赔偿数额的问题上,笔者创造性地提出了运用弹性倍数法确定惩罚性赔偿数额的基数的方法,并厘定了确定惩罚性赔偿具体数额的考量因素。【关键字】:缺陷产品;惩罚性损害赔偿;产品责任IAbstractItha
