1、摘要自英美法系国家通过判例确立惩罚性损害赔偿制度以来，该制度在其民事损害赔偿领域得到了普遍运用。而大陆法系国家固守民事赔偿应以补偿实际损失为限的理念，所以对惩罚性损害赔偿制度一直予以排斥。然而，近年来随着社会经济的不断发展变化，社会生活变得日趋复杂，各种恶意侵犯他人合法权益、毫不顾及他人财产、人身安全的行为时有发生，此时依靠传统的补偿原则已不能对受害人的损失予以充分的救济，传统的民事赔偿制度已暴露出诸多的缺陷，越来越不能适应社会发展的需要。惩罚性损害赔偿制度由于其所特有的民事救济功能而越来越受到各国理论界和实务界的广泛关注。文章从惩罚性损害赔偿制度的由来、发展
2、趋势入手，阐述了惩罚性损害赔偿制度的概念和特征、构成要件及与其它相关制度的区别；文章分析了惩罚性损害赔偿制度的理论基础、社会功能及其价值，澄清了一些与惩罚性损害赔偿制度相关的理论问题，以此为基础，论证了惩罚性损害赔偿制度存在的合理性和实施的可行性；文章通过分析、检讨我国现有惩罚性损害赔偿制度的立法，探讨了惩罚性损害赔偿制度的适用范围和适用条件，并就在司法实践中如何确定惩罚性损害赔偿数额提出了自己的见解。关键词：民事责任；民事损害赔偿；补偿性损害赔偿；惩罚性损害赔偿；IAbstractThepunitivedamagessystemhasbeenadoptedan
