3、efitstotheownersofrightssothatmorepeoplewillbeencouragedtodiscoverandpossessthetradesecrets.Tocertainspatial-temporalextent,themorepeopleknowaboutatradesecret,themorecontributionswillbemadetothesocialprogress.However,ifnoprotectionismadetothetradesecretsonlegalsen

4、se,therewillnoowner’srightsatallandwhattherightownercanseeisthathiseffortsarebeingusedfreeofchargebythewholesociety.Therefore,itisnecessarytoprotectthetradesecrets,embodyinginthefollowingaspects:(A)IncentiveEffectandEconomicRationalityofTradeSecretProtectionAsthet

5、radesecretsarethoseresourcesandinformationwhichareobtainedinthecourseofoperatingactivitiesdonebytheoperatorsandwhichareresourcestocarryoutfurtheroperationsandthebasistomakedecisionsforoperators,itwillbecomedifficultforoperatorstomaintaintheirbusinessiftheirtradese

6、cretsareseverelyinfringed,andthesocialprogresswillbeobstructedbecausesuchinfringementwilldeprivetheoperatorsoftheincentivemechanismforinformationinnovation.Itisalsotoprotectthefairnessandsafetyofsocialeconomicbyprotectingthetradesecrets.Confirmingandsafeguardingth

7、epropertyrightoftradesecretsaimsatmakingareasonablearrangementfortheinnovationcostandreturnssoastobringthecostandthereturnscloserandtoencouragepeopletodevelopandcreateintangibleproperties.Toprotectthetradesecretsmeansthatcertainpropertytitlewillbeprotectedtosomeex
