1、环境公益诉讼原告主体资格摘要:伴随着经济社会的前进与人类对于自然资源的开发与利用,环境问题也逐渐的得到人们的普遍。诸如各种大气污染,生活污染,面源污染加重,工矿污染凸显,以及河流污染等,这些问题不仅严重影响我国人们的生活环境和身体健康,而且还将带来那以解决环境污染危害,严重污染我国环境,对我国的经济社会的可持续发展构成不可忽视的威胁。所以,人们逐渐认识到要建立与完善符合我国国情的环境公益诉讼制度,以便应对形形色色的各种环境破坏,保护人类社会赖以生存的自然环境。然而,我国的环境公益诉讼起步较晚,目前发
2、展不够完善,但与在诸多发达国家相比,我国环境公益诉讼的最大问题在于缺少必要的公众参与机制。所以,当前在我国环境公益诉讼中对于原告主体资格的确立成为问题的关键。而本文在系统阐述了环境公益诉讼原告资格的概念、环境公益诉讼原告主体资格的概念的同时,还结合我国当前环境司法实践发展的现实情况,合理的分析了我国环境公益诉讼原告主体资格这一制度存在的问题,以及切实的提出了关于这一问题发展的有效化的解决建议与措施。这对于广大公民个人参与环境公共事务,推进环境立法决策的民主化、公平性,具有不可替代的深远意义。关键词:
