4、引101中国精神病收治制度法律分析报告AbstractStatisticsreleasedbytheChineseCenterforDiseaseControlandPreventionin2009showedthatmentalillnessinChinaaffectsapopulationofover100million,ofwhom16millionareseverelyill.Meanwhile,majorflawsintheChineseinvoluntarycommitmentsystemremainuna
5、ddressed.Theseweaknessesnotonlyendangerthepublic,butexposeeverycitizentothethreatofarbitrarycommitment.ThepublicexpectsthefutureChineseMentalHealthLawtoaddressthecurrentdisorderbyinstitutingconsistentstandardsandproceduresforcivilcommitment.Thepsychiatriccommuni
6、ty,however,havecontinuedtoemphasizeitslackofresources.Asaresult,involuntarycommitmenthasfollowedonlyaslowpathtoruleoflaw.ThisReportisbasedonathree-yearstudyofmorethan100casesofinvoluntarycommitment,30relevantlawsandregulations,andover300newsreports.Thesecaseshav
7、edrawnusapictureofthecommitmentofthosewhoshouldnotbecommitted,andtheneglectofthosewhoshould;andthethreattothepubliccausedbythismisplacementofresources.ThisReportarguesthattheChinesesystemofinvoluntarycommitmenthaseightmajorflaws,foundedonthreefalsepsychiatricass
8、umptions.ItanalyzestheongoingdraftinganddevelopmentoftheChineseMentalHealthLawandputsforthfiverecommendations,centeredonthedevelopmentofeffectivemechanismsthroughwhichpatientscandisputetheircommitment,andtherighttolegalcounselforthementallyill.TheStatusQuo:thePu
9、blicFacesaDoubleThreatThisreportundertakesanexaminationofnumerousnewsreportsandcases–theLiuYalinchildkillings,theChenJian'ancase,theJiangsuZhuJinhongcase,theGuangzhouHeJinrongcase,theShenzhenZouYijuncase,andothers–andfindstheChinesepsychiatriccommitmentsystemtob
