1、中文摘要刑法的适用须遵守罪刑法定原则，其适用过程其实就是对刑法进行解释的过程，刑法规范具有一定程度的抽象性，只有通过解释方与具体案件结合起来。然而，解释方法的差异就会直接导致刑法适用结果的不同。为了防止刑法被任意解释，导致解释权的滥用，需要我们在坚持罪刑法定原则的前提下，对刑法适用解释的方法进行深入地研究，以便对解释结果的正当性、稳定性以及普遍适用性予以保障，促使刑法适用得出合理的结论。本文从罪刑法定原则与刑法解释的关系入手，阐述刑法解释必须要遵守罪刑法定的精神，并对形式解释论与实质解释论两种学说进行了系统的比较研究，在分析二者的优先地位时，从两种解释论与罪刑法定原则的关系、与刑法合理
