2、lishingthecommonorganizationofagriculturalmarketsandtheRegulationsadoptedpursuanttoArticle235oftheTreatyapplicabletogoodsmanufacturedfromagriculturalproducts,andinparticulartheprovisionsofthoseRegulationswhichallowforderogationfromthegeneralprinciplethatprotectivemeasuresatfrontiersmaybereplaceds
3、olelybythemeasuresprovidedforinthoseRegulations,HavingregardtotheproposalfromtheCommission(1),HavingregardtotheopinionoftheEuropeanParliament(2),(1)Whereas,byRegulation(EC)No2423/88(3),theCounciladoptedcommonrulesforprotectionagainstdumpedorsubsidizedimportsfromcountrieswhicharenotmembersoftheEur
4、opeanCommunity;(2)Whereasthoseruleswereadoptedinaccordancewithexistinginternationalobligations,inparticularthosearisingfromArticleVIoftheGeneralAgreementonTariffsandTrade(hereinafterreferredtoas'GATT`),fromtheAgreementonImplementationofArticleVIoftheGATT(1979Anti-DumpingCode)andfromtheAgreementon
5、InterpretationandApplicationofArticlesVI,XVIandXXIIIoftheGATT(CodeonSubsidiesandCountervailingDuties);(3)Whereasthemultilateraltradenegotiationsconcludedin1994haveledtonewAgreementsontheimplementationofArticleVIofGATTanditisthereforeappropriatetoamendtheCommunityrulesinthelightofthesenewAgreement
6、s;whereasisitalsodesirable,inthelightofthedifferentnatureofthenewrulesfordumpingandsubsidiesrespectively,tohaveaseparatebodyofCommunityrulesineachofthosetwoareas;whereas,consequently,thenewrulesonprotectionagainstsubsidiesandcountervailingdutiesarecontainedinaseparateRegulation;(4)Whereas,inapply
7、ingtherulesitisessential,inordertomaintainthebalanceofrightsandobligationswhichtheGATTAgreementestablishes,thattheCommunitytakeaccountofhowtheyareinterpretedbytheCommunity'smajortradingpartners;(5)Whereasthenewagreemen
