1、中文摘要摘要海洋面积辽阔，约占地球表面积的71％，是巨大的资源宝库，是地球生命的发源地。海洋环境是环境资源重要的组成部分，然而，随着人类社会开发海洋与利用海洋活动的不断增多，海洋环境污染现象也日趋严重。全球海洋环境的迅速恶化，使人类生存的基本条件受到很大威胁；国际海洋环境犯罪行为的日趋严重，也使人类环境权遭到前所未有的侵害。本文首先从海洋环境污染的现状分析入手，预测海洋环境污染的发展趋势。海洋与其他自然资源相比，具有更强的国际性，一个国家境内的海洋环境污染行为不仅会破坏本国环境系统，而且很可能殃及其他国家乃至危及整

2、个地球的生态系统。鉴于海洋环境污染行为存在的巨大危害性，本文前三部分通过对国内外防治海洋环境污染的相关立法的对比研究，论证将海洋环境污染认定为犯罪并将其上升到国际犯罪加以惩治的必要性与合理性，第四部分结合我国目前海洋环境犯罪的现状，阐述了我国在预防、打击海洋环境犯罪方面做出的努力以及存在的问题，有针对性的提出相关修改建议，文章的最后部分对惩治危害海洋环境国际犯罪的司法合作进行了研究，以期在司法实践中对于打击海洋环境犯罪有所裨益。关键词：海洋环境污染：国际犯罪；法律对策英文摘要PoHufionofthemarinee
