1、AutomobileGraveyardandJunkyardOrdinanceSection1.PurposeThepurposeofthisordinanceistoprovideadequatecontrolstoensurethatautomobilegraveyards,automobilerecyclingbusinessesandjunkyardsdonothaveadeleteriousimpactontheTown’shealth,safety,generalwelfareandpropertyvalues.S
2、ection2.AuthorityThisordinanceisenactedpursuanttoTitle30-A,Section3001andSection3751-55oftheMaineRevisedStatutesAnnotatedasamended.Section3.ApplicabilityThisordinanceshallapplytoallautomobilegraveyards,automobilerecyclingbusinessesandjunkyardsasdefinedinTitle30-AM.R
3、.S.A.Section3752andasfurtherdefinedinAppendixAtothisordinance,whichisincorporatedhereinbyreference,whetherlocatedonprivateorcommercialproperty.Thisordinanceshallnotapplytothetemporarystorage,asdefinedinAppendixA,ofmotorvehiclesthatarewreckedordismantledandawaitingre
4、pair.Section4.PermitsRequiredUnlessotherwiseprovidedbytheCouncil,theCodeEnforcementOfficershallberequiredtoadministerthisordinance.Asprovidedforinthissection,theTownCouncilshallissueallpermitsaccordingtotherequirementssetforthbelow.4.1Nopersonorentitymayestablish,op
5、erateormaintainanautomobilegraveyard,automobilerecyclingbusinessesorjunkyardwithoutfirstobtaininganontransferablepermitfromtheTownCouncil.4.2Allpermits,whetherneworrenewalsshallbeissuedannually.PermitsshallbecomeeffectiveOctober1standexpireSeptember30th25ofeachyear.
6、Anannualfeeof$50willbechargedforneworrenewalpermits.NewpermitsissuedduringtheyearshallexpireonSeptember30thandmustberenewedforthenextyear.4.3Priortoapprovalofanypermit,neworrenewal,theCEOshallinspectthesitetoinsurecompliancewiththisOrdinanceandStateautomobilegraveya
7、rds,automobilerecyclingbusinessesandjunkyardlaws.4.4Forallproposedpermits,theTownshallscheduleaPublicHearing.AnoticeofsaidHearingshallbesenttotheTownCouncilandallabuttingpropertyowners,postedattheTownOfficeandthePublicLibraryandpublishedinthelocalnewspaperatleast7an
8、dnotmorethan14daysbeforesaidHearing.Thecostofpostingandpublishingsaidnoticeshallbepaidbytheapplicant.4.5Forallpermitapplicationsforanewaut
