3、customswarehouse.WhenthewineswentintocirculationinMay1992,Rackeinvokedtheprogramofpreferentialcustomsratessetupbya1980Co-operationAgreementbetweentheMemberStatesoftheEuropeanCommunityandtheSocialistFederalRepublicofYugoslavia(the"Agreement").ByRegulation314/83,theEChadalso
4、approvedit.TheGermancustomsauthorities,however,calleduponRacketopaythedifferencebetweenthethirdcountryrateandthelowerrateundertheAgreement.TheycontendedthatthetradeconcessionsonwhichRacketriedtorelynolongerappliedsinceRegulation3300/91(theRegulation)hadsuspendedtheAgreemen
5、tinNovember1991.TherecitalstotheRegulationexplainedthat,despiteanappealbytheECanditsMemberStatesforobediencetotheHaguecease-fireagreementofOctober4,1991,thepartieskeptonfighting.Rackebroughtsuitagainstthecustomsagency,challengingitsdenialofpreferentialtreatmentundertheAgre
6、ement.AstoanywineRackehadimportedafterNovember1991,thecourtdismissedtheaction.RackeappealedtotheGermanfederalcourt.Itarguedthattheinternationallawdoctrineofrebussicstantibusor"fundamentalchangeofcircumstances"asformulatedinArticle62(1)oftheViennaConventionontheLawofTreatie
7、s[May23,1969,U.N.Doc.A/CONF.39/27]didnotjustifytheunilateralsuspensionoftheAgreement.TheGermanfederalcourt,however,ruledthatthedisintegrationofYugoslaviaintoseveralnewstatesplustheviolenthostilitiesthatfollowedcouldamounttoafundamentalchange.Ontheotherhand,thisdidnot,inthe
8、court'sview,radicallyaltertheextentoftheparties'obligationstowardseachotherunderArticle62
