1、BALLASTWATERDISCHARGESTANDARDSREPORTANDRECOMMENDATIONOFTHECALIFORNIAADVISORYPANELONBALLASTWATERPERFORMANCESTANDARDSSUMMARYOFADVISORYPANELRECOMMENDATIONTheAdvisoryPanelrecommendsthattheStateofCaliforniaadopttheballastwaterdischargestandardsdescribedbelowinordertoreducetheintroductionofharmfulexotic

2、speciesintoCalifornia'scoastalwaters.TherecommendedstandardsaremorestringentthanthoseproposedineithertheInternationalMaritimeOrganization(IMO)ConventionorinlegislationintroducedintheU.S.SenatebecausethePanelhasdeterminedthatthosestandardsareinadequatetopreventtheintroductionofnewexoticspeciesthatc

3、ouldhavesignificantdamagingimpactsonCalifornia'saquaticecosystemsandonitseconomy.Existingtechnologiesarecapableofachievingtherecommendedstandards.Theprimarychallengeistoadaptthesetechnologiesforapplicationtotheconditionsandoperationalrequirementsofballastwaterdischarges.Toaccomplishthisinanorderly

4、andeconomicalmanner,thePanelrecommendsaphasedandtieredimplementationapproachconsistentwithotherproposals.ThePanel'srecommendationwasadoptedbyamajorityofthePanelmembers.MembersrepresentingtheshippingindustrystatedthattheyrecommendalignmentwithStateandfederalstandardssotheshippingindustrydoesnothave

5、todealwithdifferentdischargerequirementsindifferentpartsofthecountry.TheythereforefelttheycouldnotendorsethemajorityrecommendationbecauseitdiffersfromstandardscontainedinpendingSenatelegislation.(MinorityopinionsareincludedintheAppendix.)ThePaneldidnothavetimeorresourcestoconsidermanykeyaspectsofi

6、mplementingdischargestandards,includingprogramfunding,monitoringofdischarges,environmentalmonitoringandassessmentofprogrameffectiveness.ItwouldbehelpfultoeitherreconvenethisPanelortoconveneanewindependentpanelofappropriateexpertandstakeholderpartiestomakerecommendationsontheseissues.LEGISLATIVEAUT
