1、论回族婚姻习惯法与《婚姻法》的冲突与调适23摘要婚姻是人类生活的基本方面。中国人婚姻观从以往的包办逐渐演变为现在的自由恋爱，大多数父母已不再干预子女的婚姻了，从而保障了我国婚姻自由原则。回族作为我国少数民族虔诚地信奉着伊斯兰教，婚姻习俗也是严格奉承着穆斯林教义《古兰经》的规定，长期以来,回族婚姻习惯法已经被回族民众普遍接受并成为其生活准则的重要组成部分。然而，回族婚姻习惯法与我国婚姻法之间存在着很大的冲突。本文主要通过《古兰经》对回族婚姻的规定以及我的成长过程中所了解到的关于回族婚姻习惯的各个方面来归纳出回族婚

2、姻习惯法的基本内容和特点。再通过与我国婚姻法的对比得出回族婚姻习惯法与我国婚姻法之间的冲突，从而找出调适的方法，使我国婚姻法在民族地区能够更好的实施，从而促进我国的民族团结和国家稳定。本文除结语共分为两章，第一章是对回族婚姻习惯法基本内容和特点的介绍。第一节主要讲了回族婚姻习惯法的主要内容，包括婚姻的缔结（结婚年龄、宗教信仰与婚姻自由）、婚姻的禁忌（反对近亲结婚、一夫一妻制与贞操问题）以及离婚的相关问题。第二节主要讲了回族婚姻习惯法的特点，包括回族的“内婚制”、“女子不外嫁原则”及其原因。第二章是回族婚姻习惯法
