1、毕业论文：精神损害赔偿问题研究系：职教部行政管理系专业：书记官学生：指导教师：完成日期：2011-06-20精神损害赔偿问题研究摘要说到精神损害赔偿首先要明确什么是精神损害赔偿，我国多年以来，经过学术界不懈的探讨以及司法实践，虽然在精神损害赔偿理论研究方面有所进展，审判实践中也积累了一定的经验，但是我国目前的精神损害赔偿制度还不够成熟完善，尚有很多工作需要去做，比如，精神损害赔偿的适用范围中配偶权，贞操权，刑事案件中精神损害赔偿等。司法实践中也因此对该问题的处理上出现较大差异。精神损害赔偿是民法中的一个重大理论问题，也是今年来的热点问

2、题。精神损害赔偿的定义应为民事主体因其人身权或特定财产权受到不法侵害导致精神创伤和精神损失，而要求侵权人通过财产赔偿等方式对其进行救济和保护，使被害人利益达到最小并以安抚其精神损害的民事法律制度。由于缺乏明确的法律依据使得许多精神损害赔偿的问题未能得到妥善解决，这与我国的社会法制的发展要求极度不符，本文在总结前人研究的基础上，通过解析精神损害赔偿的功能和原则，指出我国精神损害赔偿的立法现状及不足，对完善我国精神损害赔偿制度提出几点思考，试图对精神损害赔偿某些方面做一下补充和探讨。关键词精神损害；精神损害赔偿；适用范围；赔偿原则Abst
