1、兰州大学硕士学位论文“律师伪证罪”存废问题研究姓名：娄丽娟申请学位级别：硕士专业：刑法学指导教师：陈航20090501兰州人学硕十学位论文“律师伪证替”存废问题研究中文摘要1997年新刑法颁布伊始，第306条规定的辩护人、诉讼代理人毁灭证据、伪造证据、妨害作证罪就引起了广泛的争议。随着律师因涉嫌伪证而身陷囹圄的案例增加，该罪名也引起了理论界和实务界的高度关注，律师界形象的将“律师伪证罪”称为“一把悬在头上的利剑”，对该条的反对呼声也最为强烈。本文共分为三个部分。第一部分对“律师伪证罪”主废论与主存论

2、的主要观点进行说明。主废论的观点认为“律师伪证罪"除了违反刑法的谦抑性原则以及刑事立法的平等、公平原则以外，还使得律师在刑事辩护中遭受的风险及遭到职业报复的可能性大大增加，降低了办理刑事案件的积极性；主存论则认为律师缺乏办理刑事案件积极性与“律师伪证罪’’并无直接联系，而且律师作为享有特殊诉讼权利的群体应该承担更多的义务。第二部分通过理论上说明刑法谦抑性原则与“律师伪证罪”并不矛盾着手，从1997年刑法修订前后，增设“律师伪证罪”的立法背景出发，将“律师伪证罪”与相似罪名进行比较，说明在现阶段不宜废
