1、中文摘要我国刑事诉讼法新的修正案增加了有关免证权的法律条款，这一修正涉及到律师——委托人免证权和亲属免证权两个层面。在伦理基础上，律师——委托人免证权是基于职业伦理的内在要求，亲属免证权则基于血缘亲情的自然需求，它们是职业伦理与亲情伦理在法律中的映射——自然不可违，人情不可逆，伦理不可悖。中华民族同根同源、同文同语、同习同俗，同为炎黄子孙，共同创造了注重伦理的华夏法律文明。无论是正在隐退的历史还是生机勃勃的当下，中国社会中固有的伦理规范都以维护整体秩序为目标，“教人以伦”，进而防止人们思想的堕落和社会的紊乱。律师——委托人免证权是借

2、鉴国外律师特权制度并结合我国国情的产物，它的伦理基础是中国文化中的“信义观”，其法律化必将很好地保护与促进律师和委托人之间的交流，更好地维护当事人的合法权益，发挥律师在刑事诉讼中的积极作用。亲属免证权制度在我国有着悠久的历史渊源，是“亲亲相隐”伦理观念在法律制度中的再现。律师——委托人免证权和亲属免证权的确立是伦理价值权衡的现实选择，具有深刻的伦理意蕴，它们必将促进我国法治的人性化发展。关键词：伦理；免证权；亲亲相隐；价值权衡AbstractThecriminalprocedurelawofourcountrynewamendmen
