1、中文摘要自古以来动物就与人类息息相关，但是动物毕竟不同于人类，动物对自身的危险性无法控制，自从人类与动物打交道开始，动物伤人或造成财产损失的事件就大量出现，我们国家现行的《侵权责任法》确立了以无过错原则为主，以过错推定原则为辅的二元归责体系，但是对于《侵权责任法》实施后社会生活中很多纷繁复杂的新情况还没有纳入进来，特别是关于动物园饲养动物侵权责任的过错推定责任原则在实践中值得探讨，所以本文从归责原则、构成要件、具体责任的承担等几个方面来研究饲养动物侵权责任问题。全文共分三个部分：第一部分在对中外饲养

2、动物侵权责任归责原则对比的基础上，重点阐述了我国《侵权责任法》规定的二元归责原则及对动物园饲养动物侵权责任归责原则的思考。第二部分通过致害动物、致害行为、致害结果、因果关系四个方面分析饲养动物侵权责任的构成要件，并对免责事由进行论述。第三部分通过从一般到特殊逐步展开的方式对《侵权责任法》有关饲养动物侵权责任承担的规定进行具体分析，并对几种特殊情况下的责任承担进行探讨。关键词：饲养动物；归责原则；构成要件：责任承担黑龙江大学硕士学位论文AbstractSinceancienttimes，animals
