1、中文摘要共同过失犯罪能否成立共同犯罪在理论界争论已久，随着实践的发展和理论研究的深入，肯定共同过失犯罪构成共同犯罪得到越来越多的国外学者的支持。而在我国，刑法明确将共同过失犯罪排除在共同犯罪之外，否定共同过失犯罪构成共同犯罪为目前通说。但是，近年来，共同过失犯罪逐渐增多，并且造成了严重的社会危害性，按照传统的刑法理论已经不能制止其所造成的危害，因此本文从共同过失犯罪在国内外的立法例及理论纷争入手，在分析了过失共同犯罪成立的理论和实践依据的基础上，肯定了过失共同犯罪构成共同犯罪，进而对过失共同犯罪的概念、成立条件、成立的范围及与相关概念的关系进行了界定，并且将其范围仅限定为共同过失正犯
