2、liedDuties(DGAD)functioningintheDept.ofCommerceintheMinistryofCommerceandIndustryandthesameisheadedbythe"DesignatedAuthority".TheDesignatedAuthority’sfunction,however,isonlytoconducttheantidumping/antisubsidy&countervailingdutyinvestigationandmakerecommendationtotheGovernmentforimpositionofantidum

3、pingorantisubsidymeasures.Suchdutyisfinallyimposed/leviedbyaNotificationoftheMinistryofFinance.Thus,whiletheDepartmentofCommercerecommendstheAnti-dumpingduty,itistheMinistryofFinance,whichleviessuchduty.Safeguardmeasures,ontheotherhand,areadministeredbyanotherAuthoritynamely,DirectorGeneral(Safegu

4、ard),whichfunctionsundertheDept.ofRevenue,MinistryofFinance.TheStandingBoardofSafeguards(chairedbytheCommerceSecretary)considerstherecommendationsoftheDG(Safeguards)andthenrecommendstheimpositionsoftheSafeguardDutyasitdeemsfit,totheMinistryofFinancewhichleviestheduty.Q.2Whocanmakeanapplicationfori

5、nitiationofAntiDumpinginvestigationandimpositionofADduty?Ans.ApplicationscanbemadebyoronbehalfoftheconcerneddomesticindustrytotheDesignatedAuthorityintheDept.ofCommerceforaninvestigationintoallegeddumpingofaproductintoIndia.UndertheRulesavalidapplicationcanbemadeonlybythosepetitioners/domesticprod

6、ucerswhoexpresslysupporttheapplication,andaccountformorethan25%oftotaldomesticproductionofthelikearticleinquestion.Theapplicationisdeemedtohavebeenmadebyoronbehalfofthedomesticindustry,ifitissupportedbythosedomesticproducerswhosecollectiveoutputconstitutesmorethanfiftypercentofthetotalproductionof
