1、AgreementonPreshipmentInspectionMembers,NotingthatMinisterson20September1986agreedthattheUruguayRoundofMultilateralTradeNegotiationsshallaimto"bringaboutfurtherliberalizationandexpansionofworldtrade55,"strengthentheroleofGATT"and"increasetheresponsivenessoftheGATTsystemtotheevolvingi

2、ntemationaleconomicenvironment";NotingthatanumberofdevelopingcountryMembershaverecoursetopreshipmentinspection;Recognizingtheneedofdevelopingcountriestodosotoraslongandinsofarasitisnecessarytoverifythequality,quantityorpriceofimportedgoods;Mindfulthatsuchprogrammesmustbecarriedoutwit

3、houtgivingrisetounnecessarydelaysorunequaltreatment;NotingthatthisinspectionisbydefinitioncarriedoutontheterritoryofexporterMembers;RecognizingtheneedtoestablishanagreedinternationalframeworkofrightsandobligationsofbothuserMembersandexporterMembers;Recognizingthattheprinciplesandobli

4、gationsofGATT1994applytothoseactivitiesofpreshipmentinspectionentitiesthataremandatedbygovernmentsthatareMembersoftheWTO;Recognizingthatitisdesirabletoprovidetransparencyoftheoperationofpreshipmentinspectionentitiesandoflawsandregulationsrelatingtopreshipnientinspection;Desiringtopro

5、videforthespeedy,effectiveandequitableresolutionofdisputesbetweenexportersandpreshipmentinspectionentitiesarisingunderthisAgreement;Herebyagreeasfollows:Article1:Coverage—Definitions_1.ThisAgreementshallapplytoallpreshipmentinspectionactivitiescarriedoutontheterritoryofMembers,whethe

6、rsuchactivitiesarecontractedormandatedbythegovernmerit,oranygovernmentbody,ofaMember.2.Theterm“userMember^meansaMemberofwhichthegovernmentoranygovernmentbodycontractsforormandatestheuseofpreshipmentinspectionactivities.3.Preshipmentinspectionactivitiesareallactivitiesrelatingtothever
