1、AGREEMENTONPRESHIPMENTINSPECTIONMembers,NotingthatMinisterson20 September 1986agreedthattheUruguayRoundofMultilateralTradeNegotiationsshallaimto"bringaboutfurtherliberalizationandexpansionofworldtrade","strengthentheroleofGATT"and"increasetheresponsivenessoftheGATTsystemtotheevolvinginternati

2、onaleconomicenvironment";NotingthatanumberofdevelopingcountryMembershaverecoursetopreshipmentinspection;Recognizingtheneedofdevelopingcountriestodosoforaslongandinsofarasitisnecessarytoverifythequality,quantityorpriceofimportedgoods;Mindfulthatsuchprogrammesmustbecarriedoutwithoutgivingriseto

3、unnecessarydelaysorunequaltreatment;NotingthatthisinspectionisbydefinitioncarriedoutontheterritoryofexporterMembers;RecognizingtheneedtoestablishanagreedinternationalframeworkofrightsandobligationsofbothuserMembersandexporterMembers;RecognizingthattheprinciplesandobligationsofGATT 1994applyto

4、thoseactivitiesofpreshipmentinspectionentitiesthataremandatedbygovernmentsthatareMembersoftheWTO;Recognizingthatitisdesirabletoprovidetransparencyoftheoperationofpreshipmentinspectionentitiesandoflawsandregulationsrelatingtopreshipmentinspection;Desiringtoprovideforthespeedy,effectiveandequit

5、ableresolutionofdisputesbetweenexportersandpreshipmentinspectionentitiesarisingunderthisAgreement;Herebyagreeasfollows:Article 1Coverage-Definitions1.ThisAgreementshallapplytoallpreshipmentinspectionactivitiescarriedoutontheterritoryofMembers,whethersuchactivitiesarecontractedormandatedbytheg

6、overnment,oranygovernmentbody,ofaMember.2.Theterm"userMember"meansaMemberofwhichthegovernmentoranygovernmentbodycontractsforormandatestheuseofpreshipmentinspectionactivities.3.Preshipmentinspectionactivitiesareallactivitiesrelatingtotheverificationofthequality,thequantity,theprice,includingcu

7、rrencyexchangerateandfinancialterms,and/orthecustomsclassificationofgoodstobeexportedtotheterritoryoftheuserMember.4.Theterm"preshipmentinspectionentity"isanyentitycontractedormandatedbyaMembertocarryoutpreshipmentinspectionactivities.Itisund
