1、（2011届）毕业论文题目:“钓鱼执法”的法律问题探析姓名：学院：专业：法学班级：学号：指导教师：导师学科：教务处制二零——年五月二十日“钓鱼执法”的法律问题探析［摘要］:钓鱼执法指的是对于那些取证困难的案件或者说那些社会危害性较大的案件所采用的执法方式，在刑事领域常常被适用，而在行政领域，在我国，虽然没有法律的支撑，却也常常适用钓鱼执法，可以说钓鱼执法可以在刑事领域内适用，却没法在行政领域适用。纵观钓鱼执法产生的原因，主要有以下方面：一是政府人员的执法理念偏差，二是经费保障不足，三是查处黑车难，四是执法人员素质不高。钓鱼执法，从行政法的角度
2、看，是违反行政法的合法性和合理性原则，违反程序正当原则，违反诚实守信原则，违反中华民族的传统道德，可以说，钓鱼执法，有百害而无一利。针对钓鱼执法泛滥的现象，本文主要提出了几点对策，首先，政府和相关部门，应当及时更新执法观念，改善执法的物质装备；其次全社会以及相关政府，必须尽快健全监督机制，包括政府部门的内部监督，司法部门的司法监督，社会上的舆论监督；最后，普通公民应当与政府进行良性的互动，同时政府应当保障公民积极参与行政活动。［关键词］:钓鱼执法；合法性；合理性legalissuesof“LawEnforcementbyDeceit”[Abs
