1、浮动抵押制度研究中文摘要作为国际市场经济融资担保的一种重要方式，浮动抵押制度自创设以来备受欢迎。该制度是在英国工业革命迅猛发展的同时因现冇的传统担保方式无法满足伴随着工业革命成长起来的中小企的融资需求的背景Z下，英国的律师们所创设的最终被司法界所承认并推广到世界各地的制度。由于各国在丿力史背景、文化传承、民族习惯等方面存在差异，所以浮动抵押制度被各国结合自己本土实际情况发展成为不同表现形式、具有口己国家特色的浮动抵押制度。我国也在2007年颁布的《中华人民共和国物权法》中正式引进了浮动抵押制度。但是由于我国对该制度的引进过于简单

2、粗略，实际应用性不足，使得浮动抵押制度不能完全发挥其所特有的价值，没能达到预期的社会适用效果。所以木文将通过对浮动抵押制度设立和发展的阐述，从源头上把握浮动抵押制度的产生背景，设立主体，以及不断发展和完善的浮动抵押制度，从而对我国浮动抵押制度的设立主体设定过宽的问题提出修改意见；通过对浮动抵押制度的核心灵魂，即浮动抵押的固定化和接管人制度的阐述和借鉴，并对我国浮动抵押制度屮对丁•接管人制度的缺失提岀建设性的意见；通过各国对浮动抵押制度的借鉴和发展情况的阐述，进一步为完善我国浮动抵押制度捉供具有实用性的借鉴。最后通过对上述浮动抵押

3、制度的相关阐述，对我国浮动抵押制度主体限定、抵押标的物的设定范围、引进接管人制度等方而捉出建设性意见，力求通过不断地完善我国的担保制度，来为我国浮动抵押制度的发展营造一个良好的发展环境，使其能够更好的发挥其自身价值，协调浮动抵押主体间的利益；增强中小企业的融资能力；加强企业的抵御风险的能力，延续企业的生命力；使得抵押财产物尽其用，实现资源的优化配置，减少经济发展的阻力，使得社会经济良性循环发展。最终造福社会，造福百姓。关键词：浮动抵押，固定化，接管人，制度完善TheFloatingChargeAbstractAsanimport
