3、easures,suchas"voluntary"exportrestraintagreements,whichenabledundesirableimportstobecurtailedinthefaceoftherulesimposedbytheGATT,aretobemorestringentlypunishedwithintheframeworkofthenewWorldTradeOrganisation(WTO).Itisagainstthisbackgroundthatattentionhasincreasinglybeendr

4、awntoanti-dumpingpoliciesasalegitimatestrategyagainstthetrendtowardsfreetrade.Againstthebackgroundofamultilateraltradesystembasedonmost-favourednationstatusandequaltreatmentofallmembercountries,anti-dumpingpolicies,legitimisedasa"legalobstacletounfairmethods",enableacountr

5、ytoraisethepriceof,andthushinder,undesiredimportsinaveryprecise,discriminatoryfashion.ItisincreasinglybeingclaimedthatEUanti-dumpingpoliciesarebeingusedlessasacorrectiveforunfairtradepracticesthanasanautonomousinstrumentofprotectionism.Preconditionsforanti-dumpingprocedure

6、sFromtheveryoutsettheoriginalGATTTreatymadeprovision(inArticleVI)foranti-dumpingregulationsasameansofrecourseagainstunfairtradepractices.Theconditionsapplyingtoanti-dumpingprocedureswerespecifiedfurtherintheUruguayRound.The"rulesofthegame"havebeenrenderedmorepreciseinorder

7、toimprovelegislativeconsistencyandtoensureinbothmaterialandinstitutionaltermsthattheauthoritiesbehavefairlyvisgtvisthepartiesinvolved.Inthewakeofthisamendment,changeswerealsomadetotheECanti-dumpingregulation.Aswasthecasepreviously,itisorientedstrictlytowardstheGATTtext.Asi
