1、网络服务商对网络隐私权的侵权责任摘要互联网的飞速发展，给当今社会生活带来了诸多变化和极大便利,但与此相对的，一些问题也随之而来，主要表现在：1•行业缺乏相关较为统一且严格的自律规则；2.国家缺少相关政策和法律的支持；3.公民相对缺少网络隐私权的自我保护意识。在互联网中不断发生的隐私权侵权的情形，使得网络隐私权作为公民基本权利一一隐私权的新形态受到了关注。通过对域外法律的研究可以发现，美国最初对隐私权的保护是在侵权法领域内进行的规定，而目前学界正在讨论的是隐私权应在侵权法领域规定还是在人格权法进行规定。作为网络服务的提供者，网络服务商处于网络信息传播的关键性地位，
2、如果在其提供网络服务的过程中，对其行为予以规范，这样对于网络隐私权的保护应当更有效。同样因为网络服务商所处的法律地位的特殊性使得用户隐私权益在受到网络服务商的侵犯时，其所应承担的责任也备受关注，这也是本文分析的重点。本文在对网络隐私权的概念界定、对网络隐私权的内容进行梳理的基础上，从网络服务商在网络隐私权保护中的地位出发，根据网络服务商侵犯个人隐私权的表现形式，确定对网络服务商侵犯个人隐私权的归责原则，侵权构成要件以及责任承担方式。最后针对我国关于网络隐私权保护现状的不足之处，提出完善其保护机制的建议。关键词：网络隐私权；网络服务商；归责原则；侵权责任THEIN
