1、摘要公用企业是市场经济的重要组成部分，其提供的产品或服务是其它生产厂商和人们生活不可或缺的要素。公用企业提供的产品或服务的质量也就决定了其它生产厂商和人们生活的质量。出于公益的目的，早期各国普遍对公用企业实行垄断的经营方式，并取得了较好的效果。但随着垄断弊端的显现，必须寻求另一种有效的方式代替垄断。竞争就是最好的方式。竞争是市场经济最木质的特征，是市场经济发展的根本动力。没有竞争，市场经济将会是一潭死水，毫无生机与活力。反垄断法是市场经济的“宪法”，用反垄断法來保护竞争是公用企业改革的有效手段，也是建设现代市场经济的必经之路。事物是发展的，公用

2、企业的特征在不断变化，在公用企业的自然垄断边界不断缩小的情况下，作为公用企业政府管制理论基础的自然垄断理论也必须作出修止。作为另一个理论基础的公共利益理论在实践中是经不起推敲的。另外，因为管制实践中政府往往被“俘获''和管制成本过高，所以政府管制是失灵的，没有促进社会公共利益反而保护了垄断利益。在这样的背景下，必须对公用企业进行改革，用反垄断法规制公用企业的行为。公用企业存在着自然垄断领域和非自然垄断领域的划分，反垄断法对不同的领域规制匝点也各不相同。对自然垄断领域侧重于对滥用市场支配地位的规制，而非自然垄断领域则是侧垂对限制竞争协议和企业集中
