1、绿色贸易壁垒问题及其法律对策摘要绿色贸易壁垒作为一•种新k贸易保护手段，以保护环境为山，采取各种贸易限制措施，对自山贸易产生了扭曲与限制作用。随着中国入世，市场的开放，我国环境保护与对外贸易面临新的挑战。为此，有必要加强对绿色贸易壁垒问题的理论研究，以消除其负而彫响，化解其引发的各种贸易纠纷，最终实现贸易自由化与全球环境保护协调发展。木文首先概述了绿色贸易壁垒的特征、成因和表现形式，然后阐释了其实施的法律依据，主要有GATT/WTO屮的绿色条款、WTO规则休系中其他协议包含的绿色条款、多边环境协定中与贸易有关的条款以及国内法的相关

2、规定。论文接着从绿色贸易壁垒对WTO口巾贸易基本原则、对他国主权的挑战以及对我国环境与贸易影响的分析，探讨了我国分别在国际领域、国内领域应对绿色贸易壁垒采取的法律対策，主张我国应积极参与和关问题的国际立法活动，善于利用WTO争端解决机制解决国际贸易纠纷，构建有我国特色的环保法律体系，建立我FI自己的绿色贸易壁垒。关键词：绿色贸易壁垒环境保护对外贸易外国污染转嫁WTO绿色条款法律对策AbstractAsanewly——developedtradeprotectinginstrument,greentradebarrieradopts
