1、湖南大学硕士学位论文东洞庭湖湿地权属问题研究姓名：胡晓华中请学位级别：硕士专业：法律•商法指导教师：肖海军20071110摘要湿地作为与森林和海洋并称的全球三大生态系统2—，拥有巨大的生态功能、社会功能和经济效益。东洞庭湖湿地是世界重要的湿地，东洞庭湖湿地权属问题的解决是东洞庭湖湿地保护的前提和关键。湿地（资源）作为一个整体概念，不仅包括由土壤、沙石组成的地面，积水所形成的水而、水体，而且述包括地而、水面、水体的附属资源，如植被、野生动物、沙石、水流等，乃至湿地生态系统所构成的整个环境，湿地权包括湿地所有权、湿地用益物权和湿地管理权。湿地权属，

2、是指湿地权利（力）在主体上的归属状态。湿地权属主要分为湿地民事权屈和湿地行政权属两种情形。湿地民事权屈又包括湿地所有权屈和湿地用益物权权屈。东洞庭湖湿地现状存在一•些问题，这些问题的存在产生有着齐方面的深层次原因。针对这些问题及问题产生的原因，东洞庭湖湿地权保护应遵循生态保护优先原则、生态整体性保护原则、尊重历史与习惯原则、适度与合理开发利用原则、权责相一致原则，东洞庭湖湿地权保护的具体对策包括明确东洞庭湖湿地国家所有权的行使代表、健全禁限产利益补偿制度、东洞庭湖湿地资源开发禁限制度、统一管理体制、资源损害补救制度、开发保护权责统一制度以及构建
