1、本文从行政自由裁量权的基本概念入手，通过对行政自由裁量权的历史沿革、基本分类、存在的必然性、运行规则等方面的综合考察，认真分析了滥用自由裁量权的表现形式、原因及其危害，提出了对行政自由裁量权控制的立法途径、司法审查途径、程序控制途径和行政法治原则途径，试图在加强对行政自由裁量权进一步认识的基础上，探索一条对行政自由裁量权行使和控制的有效途径，为行政执法工作提供一个方法论的指导。本文第一部分概要介绍了行政自由裁量权的概念，从行政法的法律渊源和行政行为要件两个方面对行政自由裁量权进行了分类，详细探究了行政自由裁量权的历史沿革存在的必然性。第二部分从行政自由裁量权的基本特

2、点出发，从实体规则和程序规则两个层面上来探讨行政自由裁量权运行的特殊法律规则。第三部分首先指出了我国现阶段滥用行政自由裁量权的一系列现实表现，分析了滥用自由裁量权的成因及其对社会主义法治建设的危害，在此基础上，通过借鉴中外行政法学的研究成果，归纳了我国控制自由裁量权的六条标准，最后，提出了控制自由裁量权的四方面途径。任何行政自由裁量权的存在都有其特定的历史和社会背景，脱离特定的时代和历史背景来抽象地谈论行政自由裁量权是没有任何实际意义的。当今社会，我们在充分承认行政自由裁量权存在的合理性和必要性的基础上，来深入地研究对行政自由裁量权的控制方法，其目的是为了更好地、最
