3、yRightLawofthePeople'sRepublicofChinaandtheCivilProcedureLawofthePeople'sRepublicofChinaandbasedonadjudicationpracticesforthepurposeofcorrectlytryingcasesofdisputesoversalesandpurchasecontracts.1.EstablishmentandEffectofSalesandPurchaseContractsArticle1Ifthereisnowrittencontract

4、betweenthepartiesconcernedandonepartyclaimstheexistenceofcontractualrelationshipofsalesandpurchasewithdeliverynotes,acceptancenotes,settlementnotesorinvoices,thepeople’scourtshalldeterminewhetherasalesandpurchasecontractisestablishedbasedonthemethodoftransactionbetweentheparties

5、concerned,thetransactionhabitsandotherrelevantevidences.Ifthenameofthecreditorisnotstatedinthelettersorevidencessuchasthereconciliationconfirmationletterortheletterofconfirmationofcreditor’srightandapartytothesalesandpurchasecontractprovestheexistenceofcontractualrelationshipofs
