3、roeconomics.Severaleconomicsmodelsareprovidedtosupporttheefficiencyargument.Thispaperconcludesthatthefoodstampprogramhascreatedthemaximumutilityoflow-incomehouseholdsthroughasubtleallotmentoffreesubsidizedfood.Thelawpreventsthewelfarefrombeingabusedbyrecipients.Intheseregards,theFSAis

5、orgeMasonUniversity公共政策博士生。Email信箱scholar@ydu.edu.tw摘要本文旨在探討以經濟學作為立法政策基礎之可行性與實用性。本文以美國食物券法為例，分析其修法之經濟學考量，並以個體經濟學之消費者選擇理論為基礎，援引經濟學模型以進一步剖析比較修法前後之經濟效益與公平性。本文結論認為該法巧妙的以定額制度為低收入戶創造最大經濟效益、同時確保社會福利不致遭濫用，實為經濟學應用於立法政策與立法例之成功典範。在立法實務方面，對於台灣之社會福利法制之立法有相當參考價值。此立法例可證明運用經濟學原理制定政策與推動立法具有高度可行性。關鍵字：法

6、律經濟學、美國食物券法、公共政策-139-法律經濟學對公共政策之效益分析－以美國食物券法之立法例為例壹、法律與經濟學之相容性與研究方法法律經濟學(LawandEconomicsorEconomicAnalysisofLaw)是一門橫跨法學與經濟學之整合學術研究(interdisciplinarystudy)。近幾年，來國內少數的經濟學者陸續發表有關這方面的研究心得，國內幾位法律經濟學先進例如熊秉元教授、劉靜怡教授、林立教授均有專論探討將經濟學原理應用於法律學之理想性與實用性，尤其熊秉元之著作最為豐碩。法學界很少跨出門戶向經濟學取經，司法實務界更是尚未聽聞有識之士以

7、經濟學為認事用法之準繩者。美國與英國則已將法律經濟學併列為跨科系之重要學門。早期(二次大戰之前)之美國經濟學者針對市場之壟斷行為(monopoly)進行經濟學分析，進而提出反托辣斯(anti-trust)立法建議。二戰之後，經濟學者與法律學者不約而同的轉向研究私人財產權(propertyrights)之維護、重分配以及社會最大利益化。現代法律經濟學界的發展首推一九六Ｏ年美國學者RonaldCoase發表於法律與經濟學報之「社會成本之問題」為濫觴。從此，寇式定理(theCoaseTheorem)成為法律、經濟、管理、公共政策等社會科學學者必讀之經典R.H.Coase
