3、icantunders.14(9)werederegulatedbytheRegulatoryReform(Patents)Order2004(“the2004Order”)inconjunctionwiththePatents(Amendment)Rules2004(“the2004Rules”).The2004Orderandthe2004RulesincorporatedtheprinciplesofArticles5and6ofthePatentLawTreaty,andbothstatutor

4、yinstrumentscameintoforceon1January2005.ThePatentsRules1995asamendedhavebeenreplacedentirelyfrom17December2007bythePatentsRules2007.CODEOFPRACTICE14.01.2TheCodeofPractice(thefirstpartofwhichcanbefoundbelow)identifiesbestpracticepointsforpatentapplicantsa

5、ndagents,whichiffollowedwidelywillleadtosavingsandefficienciesintheOffice,andconsequentlytobetterserviceandbettervalue.ExaminersandotherOfficeofficialsmayonoccasiondrawtheCodetotheattentionoftheapplicantoragent,andmayaskforittobecompliedwithbeforethecase

6、isprocessedfurtherifthatwouldbemoreefficient.14.01.3However,itisnottobeexpectedthatbestpracticecanalwaysbeadheredto.TheOfficehasnorighttodemandcompliancewiththeCodeofPracticebecausetheCodeisadvisoryonlyandhasnolegalforce.14.01.4Ifanapplicationdoesnotcomp

7、lywithoneofthepointsoftheCodeofPracticethenthisdoesnotnecessarilyjustifyanobjectionunderthePatentsActorRules.Forexample,anapplicationhavingmorethanoneindependentclaiminonecategorywouldnotcomplywithcodepoint1e,butthiswouldnotusuallyjustifyanobjectionunder
