3、29,1999,wereadoptedatthe1090thSessionoftheAdjudicationCommitteeoftheSupremePeople'sCourtonDecember1,1999andareherebypromulgated. PursuanttoTheContractLawofthePeople'sRepublicofChina（hereinafterthe"ContractLaw"）,andwithaviewtofacilitatingtheproperadjudicationofc
4、ontractualdisputes,weherebypromulgatethefollowinginterpretationsofcertainissuesconcerningtheapplicationoftheContractLawbyPeople'sCourts: I.ScopeofApplicationoftheLawClause1WhereasuitisbroughttoaPeople'sCourtinrespectofadisputearisingoutofacontractformedafterthe
5、operativedateoftheContractLaw,theprovisionsoftheContractLawshallapply;whereasuitisbroughttoaPeople'sCourtinrespectofadisputeconcerningacontractformedbeforetheoperativedateoftheContractLaw,exceptotherwiseprovidedherein,theprovisionsofthelawineffectatthetimeshalla
6、pply,providedthatifthelawineffectatthetimedidnotprovideforsuchmatter,therelevantprovisionoftheContractLawmayapply. Clause2WhereacontractwasformedbeforetheoperativedateoftheContractLaw,buttheprescribedtimelimitforperformanceextendsbeyond,orcommencesafter,theoper
7、ativedateoftheContractLaw,ifadisputearisesoutofitsperformance,therelevantprovisionsofChapterFouroftheContractLawshallapply. Clause3IndeterminingthevalidityofacontractformedbeforetheoperativedateoftheContractLaw,ifapplicationofthelawineffectatthetimeleadstoitsin
