1、宪政视域下依法治国与依法治党的良性互动〔中文摘要〕当前，党政关系已经成为推进政治体制改革、促进经济社会科学和谐持续发展的一个不可回避的问题。本文从法治、宪政的视角，阐述了依法治国、依法治党的基本概念及辩证关系，认为从宪政的互动规律和当代中国政治的基本特征可以看出，依法治党与宪政密不可分、相辅相成，并且依法治国与依法治党实现良性互动的关键是政党政治的现代化水平。依法治国和依法治党互动的现状是从积极作用和存在问题展开的，积极作用主要体现在法治原则和宪政理念基本得到确立，存在问题主要体现在与群众的联系和权力监督制衡机制的健全等执行方面。鉴于党所处执政地

2、位的特殊性和当前甚至较长时期政治地位的不可替代性，笔者认为一方面党要以高度的历史责任感加强自身的现代化建设，以党内民主带动人民民主，用依法治党保证依法治国，另一方面要用人民民主、法治建设的发展成果构建完善的权力监督制约体系，使政党与国家权力保持适当距离和良性互动，即通过依法治党与依法治国的良性互动推进公民社会与政治国家的良性互动，促进人民幸福安康、祖国繁荣富强。〔关健词〕：宪政依法治国依法治党党政关系StudyontheConstructiveMutualInfluencebetweentheGovernanceoftheGovernmentan
