2、InternationalChamberofCommerce(PublicationNo458)andarebindingonallpartiestheretoexceptasotherwiseexpresslystatedintheGuaranteeoranyamendmentthereto.Section:B.DEFINITIONSANDGENERALPROVISIONSArticle2a)ForthepurposeoftheseRules,ademandguarantee(hereinafterreferredtoas"Gu
3、arantee")meansanyguarantee,bondorotherpaymentundertaking,howevernamedordescribed,byabank,insurancecompanyorotherbodyorperson(hereinaftercalled"theGuarantor")giveninwritingforthepaymentofmoneyonpresentationinconformitywiththetermsoftheundertakingofawrittendemandforpaym
4、entandsuchotherdocument(s)(forexample,acertificatebyanarchitectorengineer,ajudgmentoranarbitralaward)asmaybespecifiedintheGuarantee,suchundertakingbeinggivei)attherequestorontheinstructionsandundertheliabilityofaparty(hereinaftercalled"thePrincipal");orii)attherequest
5、orontheinstructionsandundertheliabilityofabank,insurancecompanyoranyotherbodyorperson(hereinafter"theinstructingParty")actingontheinstructionsofaPrincipalb)Guaranteesbytheirnatureareseparatetransactionsfromthecontract(s)ortenderconditionsonwhichtheymaybebased,andGuara
6、ntorsareinnowayconcernedwithorboundbysuchcontract(s),ortenderconditions,despitetheinclusionofareferencetothemintheGuarantee.ThedutyofaGuarantorunderaGuaranteeistopaythesumorsumsthereinstatedonthepresentationofawrittendemandforpaymentandotherdocumentsspecifiedintheGuar
