2、aphySciences,NanjingNormalUniversity,Nanjing210046,China)Abstract:Actually,tourismdevelopmentcannotonlybringforthlotsofnegativeimpactsoneconomy,socio-cultureandenvironment,butalsodamagethelegalrightsandinterestsofhostcommunityresidentstodifferentextents.Itiscommonforthelegalrightsandinter
3、estsofruralresidentsinandneartouristdestinationsofChinatobedamagedduetotourismdevelopment.Butsofar,thiskindofnegativeimpacthasrarelybeenaddressedinthelightoflaw.Since1990s,Chinesescholarshavefocusedontwokindsofissuesofrightandinterestdamage.Oneiscausedbylandexploitationnearurbanareas,andt
4、heotherisfromoff-farmworkers.Theissue,causedbytourismdevelopment,ofrightsandinterestsdamageofruralresidentsinandneartouristdestinationsisalmostablindareainthelightofeithertourismorlawresearchsociety.Strengtheningitsstudiescanpromotethetheoreticalstudyontourismimpacts,andalsowillbeofgreatr
5、ealisticsignificanceinsolvingtheissuesinhostdestinationsconcerningtheso-calledthree-nongproblems,namelyagriculture,countrysideandfarmers.WithZhangjiangNationalParkasacase,thepaperaimstoexaminethelegalrightandinterestthatruralresidentshaveintourismdevelopment.Meanwhile,itattemptstounveilso
6、mecommonrightsandinterestsdamagesbytourismdevelopment.Thepaperarguesthathostcommunityresidentsshouldhavediversepolitical,personal,economic,socio-culturalrights,andthelegalrightsandinterestsoflocalresidentsaredamagedowingtovariousfactors,includinglandexploitation,residentdisplacement,touis
