1、中文摘要晚清法律移植是在内外动因的综合推动下，清政府为了收回领事裁判权、挽大厦之将倾而展开的。它以西方法律为模式，在内容、体例、原则、制度等方面基本模仿了外国法律，形成了以“六法”为基干的法律框架，引进了西方近代法制文明中的罪行法定、刑罚人道主义、司法独立等法律原则和制度。从法制近代化实证判定标准与价值判定标准两方面来看：一、晚清法律移植实现了从传统的“以刑为主、诸法合体”的法律体系逐步向着近代化的部门法体系的发展转变；二、晚清法律移植促使传统的维护封建专制、等级、特权和宗法制度、封建礼教的法律制度逐步向体现法治、民主、平等、自由等法价值的

2、新型法律制度发展变化。因此，我们说晚清法律移植开启了中国法制近代化的第一步。尽管，清政府的迅速灭亡，导致了晚清移植活动的终止。然而，中国法制现代化的进程并未因之而结束，晚清以后各时期的政府沿着晚清法律移植所开拓的法制近代化道路继续前进(尽管其中也存在着某些历史性倒退)。至今，我们还仍然在法制现代化的道路上探索前进着，我们依然需要法律移植，这是法律国际化的必然要求。但需要注意的是，现代化并不等于西化，本土资源依然是法制现代化的重要支撑，只有将移植而来的法律进行“本土制造”，才是成功的移植。这也正是晚清法律移植对我们的重要昭示。关键词：晚清修律
