1、摘要自从美国联邦巡回上诉法院于一九九八年StateStreetBank一案，肯定商业方法软件为法定专利客体以后，全球金融业、计算机业与网络公司无不寻求以专利作为保护其商业方法的武器，商业方法专利申请案件也因此而日益增多。商业方法软件是否可以成为专利法保护的客体，至今学界仍有争议而见解不一，日本专利局采取了与美国专利局相同的立场，欧洲专利局本来所持的否定见解也日益松动。事实上，美、日本以及欧洲关于此问题的实践趋势表明三方都倾向于认可满足一定的条件的商业方法可以成为法定专利客体。本文第二章首先就商业方法软件加以定义，并比较了商业方法的几种传统保护模式。第三章探

2、讨商业方法专利在美国的演进，并介绍困扰美国实务己久的“商业方法除外原则”的起源与演进，及法院于著名的StateStreetBankandTrustCo．v-SignatureFinancialGroup一案中对该等原则的突破。第四章探讨了商业方法可专利性的实质要件。第五章介绍了我国对于“商业方法”可专-利性的看法。最后，于第六章提出个人对商业方法专利的一些浅见，并就我国现行专利制度提出未来保护方向的建议，作为结论。关键词：商业方法，专利法，专利保护，可专利性ABSTRACTTheproblemofdeterminingwhetheramethodofdoi
