1、硕上学位论文摘要2008年《关于全面推进集体林权制度改革的意见》颁布，将农村土地家庭承包责任制延伸至林业领域，在我国南方林区掀起新一轮的集体林权改革。但是，我国集体林权法律制度仍然存在着法律制度不健全，林地权属不明晰；林地的收益分配制度不合理；林权流转制度不健全：林权配套制度不健全等缺陷。在国际大趋势的推动下，发展生态林业已成为一种共识，碳汇林业的开展对林权提出了更高的有求。因此，首先，有必要对集体林权的法律概念进行清晰的界定，明确集体林权的性质和法律构成，对集体林权法律制度的演变和现状进行透视分析；其次，集体林权

2、的改革应该遵循两条道路：一方面，从财产权角度来看，《物权法》颁布之后，明晰所有权主体，以用益物权理论规制林地承包经营权，确立林地承包经营权人对林地的支配权、赋予林农以排他的林地占有权。积极构建林权流转市场，完善林地使用权的一级市场，构建林地使用权的二级市场；完善林权配套保障制度，加快林权登记、林权流转纠纷仲裁机构和林地评价机构的建设。另一方面，从碳汇林业角度来看，应建立碳汇林业项目下具有明晰产权的林权制度，碳汇项目下完善的交易制度，建立适合我国国情的碳汇林业项目合作制。从而充分发挥林业的生态功能和经济功能，真正带来
