3、律制度下不易被保护，故在《著作权法（送审稿）》中提出了引入惩罚性赔偿的制度来保护著作权人。以期该制度能够有效地保护著作权人的合法权利，维护社会公共利益，进而推动社会经济的有序、健康和持续发展。本文通过调查100起真实案例，对著作权侵权损害的现状进行了实证分析，得出现行侵权损害赔偿不足以保护著作权人，并对是否引入惩罚性赔偿制度的相关争议分析后，认为惩罚性赔偿应被引入著作权法中，但草案中的规定存在一定的瑕疵。故从著作权法惩罚性赔偿的概念入手，试图明确其内涵和外延，揭示其性质和功能，并从法理学和法经济学的角度论述了

4、著作权法引入惩罚性赔偿的必要性和可行性。同时还通过对其他国家著作权法中该制度的情况分析总结，借鉴经验。在此基础上，对我国著作权法该制度的合理设置提出相关的建议，即厘清法定赔偿在惩罚性赔偿中的地位、明确惩罚性赔偿的适用条件和准确计算惩罚性赔偿金。关键词著作权，侵权，惩罚性赔偿，补偿性赔偿IABSTRACTABSTRACTAsintangiblepropertyrights.Copyrightisnoteasilyprotectedunderthecurrentlegalsystem.So,Inthecopyri
