2、利益在实质上具有交叉关系，但我国法上对二者进行了区分，且国家利益优位于环境社会公共利益。环境社会公共利益优位于侵权人的个人利益，同一侵权行为中的受害人的个人利益优位于环境社会公共利益。为有效保护优位利益，诉讼制度设计上应赋予优位利益的“代言人”以充分的程序性权利和利益，但也应注重实质公平，并符合民事诉讼的基本原理。环境民事公益诉讼中应保护好国家利益，应完善并严格执行诉前程序以尽量避免“诉监合一”双重角色下检察机关预设审判结果，同时应处理好环境民事公益诉讼与民事私益诉讼之间的界限与衔接问题。关键词：环境民事公益诉讼；利益结构；利益关系；利益选择IIIAbstractT
