1、山东人学硕Jj学位论文中文摘要贷款保证保险合同指，由投保人(借款人)向保险人交付保费，保险人按照约定，在投保人不能按贷款合同的约定归还被保险人(即贷款人，～般是贷款银行)的贷款时，由保险人予以赔付的保证保险合同。我国上个世纪90年代术才开始出现贷款保证保险业务，在我国保证保险基础理论研究不够深入，法律法规中缺少相应的规定，贷款保证保险业务在实践中产生一系列问题。本文首先对保证保险的产生和发展、保证保险的概念和特征以及保证保险的分类作了基本介绍，明确了保证保险的基本法律性质。在第二部分，本文首先对贷款保证保险合同的特征作了阐述，指明了贷款保证保险

2、合同的主体和贷款保证保险合同的保险标的。贷款保证保险合同的性质是本文的重点之一，对贷款保证保险的性质主要存在“保证说”、“保险说’’和“二元说’’三种不同学说，在比较保证保险合同和保证合同的基础上，笔者认为：保证保险合同与保证合同存在本质上的区别，贷款保证保险是一项独立的保险制度。在本文第三部分，笔者分析了保证保险合同的效力、贷款保证保险合同保险人的抗辩权、贷款保证保险中保险人的代位求偿权、贷款保证保险合同与保证保险合作协议的关系和保证保险的资信审查义务归属五个在实践中产生一系列争议的重要法律问题，这部分也是本文的重点之一。在以上论述的基础上，
