1、摘要农民专业合作社是在我国农村经济由产品经济向市场经济转换，以及我国农业从传统农业向现代农业转换的过程中，农民自发组织发展起来的一种新型的经济组织，是分散的小规模农户生产为应付竟争激烈、千变万化的市场风险，提高市场地位，降低交易成本，以及获取更多受益的有效途径。现实中，农民专业合作社存在着一些问题，而最核心的就是关于其财产权的安排。农民专业合作社的财产权问题决定了该组织的性质，关系到该组织的法律地位，影响着该组织的治理方式以及利益分配等问题，是影响组织存在与发展的关键因素。本文首先探讨农民专业合作社的特殊性对其财产权
2、的影响。农民专业合作社的财产权特征在于成员保留了其出资的所有权和受益权，成员出资后将其财产的部分权利让渡给合作社，并通过民主控制的方式参与财产控制。合作社法人财产权的表现在对其占有财产的支配权上，包括对财产的占有、使用和处分的权利。在财产责任方式上，农民专业合作社对外承担有限责任，成员对合作社以其出资为限承担有限责任。关键词:农民专业合作社，农民专业合作社的成员，财产权AbstractTherestructuringandmarketzationoftheeconomyingeneralandagriculturei
