3、t1968.Soattheverybeginning,abasicquestionincustomerprotection:whoisthecustomer?Theideaofthecustomerinlegislationisofrecentspring.ThegreatpartoflawisstillincludedintheCivilCodewritteninthelate19thcenturyonthesampleoftheCodeNapoleon.TheCodestilltodaygivesthegreatpartoftheregul
4、ationsgoverningagreementsingeneral,theagreementofsellingandthesupplyofservices.Itwillhencecomeasnosurprisethattheconceptofcustomerprotectionandthebodyofthecustomerhadnotyetbeenfavourablyidentifiedorcreatedatthatpoint.Theword“consumer”isnoticeablymissingfromtheCodewhichdidnot
5、andstilldoesnotidentifythenotionofthecustomerassuch.MuchoftheprimaryCodeisstillinitsoriginalformandsomeofitsregulationsdonotdepictthepresent,complex,activesocietyofpresettime,andsoundancientbothinconceptandinnotion.Intheregulationofsale,totakesimplyonesignificantexample,theC
6、odeadmitsthefiguresofthesellerandthepurchaser.Withtheexclusionofsomeoldcustomaryregulationssafeguardingthepositionofunderaged,womenandweak-mindedpersons,allconsumersareregardedandtreatedequallyandsimilarlybytheCivilCode.ThisguaranteedaminimumdegreeofprotectioninthekindoftheR
7、omanlaw-derivedassurancesintheregulationsgoverningtheagreementofsale.Thefirstoftheseguaranteescorrespondstopeacefulownership;thissafeguardstheaccuratepassageofpossessionrightsandsequentialenjoymentoftheproductbeingbought.Secondly,theguaranteeagainstlatentfaultsgivesaconsumer
