1、内容提要第三方介入GATT／WTO争端解决程序的问题一度伴随着其争端解决机制的发展历史并越来越受到WTO成员国的重视。在涉及WTO争端解决之时，通常情况下，WTO成员方并不是直接的申诉方或被诉方，而是以第三方的身份介入到争端解决程序中去。WTO的DSU规则对争端解决程序中第三方介入问题的理性提升和规范，已经使得第三方介入问题以前所未有的高度正式“浮出水面”。毫不夸张地说，今天几乎所有进入W'I'O争端解决程序的案件都会有一个或多个第三方介入其中。本文沿着GATT／WTO争端解决机制中第三方介入的历史轨迹，分析了WTO体制下关于第三方介入的规则和实践，同时对这些规则的

2、进步性加以肯定。第三方介入权的主要渊源是其与争端当事方之间的相关协议。DSU在第三方介入安排上所追求的，是当事方自治原则和其他WTO成员国利益之间的平衡，此外WTO争端解决机制本身的特性、经济以及信息平衡等，也都是不可忽视的因素。国际法院程序中第三国介入的规则和实践，不失为WTO争端解决程序中第三方介入问题的很好指南，实践中专家组在第三方介入权利范围上已经在向国际法院靠拢。我国作为发展中国家加入WTO后，在以经济实力为基础的国际贸易中，将会不可避免地遇到以第三方身份介入争端的维护自身权益的情形，故对此问题的规则性和理论性把握尤显重要。关键词：WTO、DSU、争端解决
